Maine voters passed legislation for the legalization of cannabis use and sale in 2016 along with California, Massachusetts, and Nevada. It is one of the last out of these states to launch adult use sales. Maine was close to issuing the first retail licenses in February 2020, however COVID19 has delayed the timeline. Maine’s current adult-use cannabis packaging and labeling regulations are important to keep up with for cannabis businesses.
Packaging and labeling requirements for cannabis may not include: packaging or labeling the product that causes confusion with a trademarked product, a design that appeals to someone under 21, or involving a human, animal or fruit on the packaging of the label.
Cannabis products must include health and safety warning statements, THC potency levels, information on gases, solvents, and chemicals used in extraction, usage instructions, ingredients/ nutritional facts for cannabis-infused products, and license/ batch numbers.
Products must be packaged in opaque, child-resistant, and tamper-evident packaging. In the case of liquids with multiple servings, packaging must have an integral measurement component and child-resistant cap.
