The use of cannabis in the state of Utah is currently limited to those who need it for medical reasons. However, Utahns get the chance in November 2020 to vote on legalizing it for recreational use by adults twenty-one and older. For the time being, Utah remains a medical use cannabis state and to distribute products to registered patients or caregivers there are regulations that must be met. Below are the requirements for packaging and labeling of medical cannabis.
Cannabis and cannabis products must be in child-resistance packaging that meets standards of 16 C.F.R. Section 1700. Additionally, the packaging needs to protect the product from contaminations and not add any toxic or deleterious substances to the product.
When labeling cannabis product, the text size needs to be in English size 10 or bigger and may not be italicized. All product needs to be labeled before it is sold to medical cannabis pharmacies or state central fill pharmacies. There is information that needs to be on all labels for both flower and cannabis products and in a specific order. Information such as cultivation facility name as well as the processing facility with the license number. Other information includes lot number, harvest date, testing date, bath number, packaged date, potency levels, cannabinoid profile, terpenoid profile, expiration date, and the quantity being sold. For cannabis flower, THC potency levels shall be the total and should not include any other levels of THC. No images, illustrations or logos may be present on the label other than a small brand logo/name at the end of the label.
Utah has specific warning statements that need to be added to product labels. The warnings include “WARNING: Cannabis has intoxicating effects and may be addictive. Do not operate a vehicle or machinery under its influence. KEEP OUT OF REACH OF CHILDREN. This product is for medical use only. Use only as directed by a qualified medical provider.”
