New York Cannabis Package and Label Laws and Requirements

New York became the 15th state to legalize recreational marijuana in 2021, following in the footsteps of other states such as California, Colorado, and Illinois. The legalization of cannabis in New York has created a new industry and presented opportunities for entrepreneurs to start cannabis businesses, but it also means strict regulations for cannabis packaging and labeling.

The New York State Department of Health (NYSDOH) oversees cannabis packaging and labeling regulations in the state. The regulations are designed to ensure the safety of cannabis products and provide clear information to consumers.

Packaging Requirements:

Additionally, the packaging must display the following information:

- The product name 

- The amount of THC and CBD in the product

- The net weight or volume of the product

- A list of all ingredients in the product

- The name and contact information of the cannabis producer

- The date of production and expiration date

- Any applicable warnings or cautions


Label Requirements:

All cannabis products in New York must have a label that includes the following information:

- The product name 

- The amount of THC and CBD in the product

- The net weight or volume of the product

- The date of production and expiration date 

- A list of all ingredients in the product 

- The name and contact information of the cannabis producer

- Any applicable warnings or cautions 

- The universal symbol for THC, which must be prominently displayed on the label 

- A unique identifier for the product, such as a batch or lot number 

- The statement "Keep out of reach of children" 

- In addition to these requirements, any advertising or marketing materials for cannabis products must include the statement "This product has not been approved by the FDA to treat, cure, or prevent any disease."
